These are the Terms of Service (“Terms”) that govern your use Story Story Night, LLC’s (“Story Story Night”) website and your purchase and use of any Story Story Night event tickets, products, or services. Your use of our website and purchase of any Story Story Night event tickets, products, or services shall constitute acceptance of these Terms.
Please also consult our Privacy Policy, which is incorporated into these Terms.
We may make changes to the Terms at any time. Any changes we make will be effective immediately when we post a revised version of the Terms on the Site. The “Last Updated” date above will tell you when the Terms were last revised. By continuing to use this site after that date, you agree to the changes. To the extent that these Terms differ from a prior version of the Terms which you previously agreed to, this version of the Terms supersedes and governs.
1. Account Registration
You may browse the website without registering for an account. You will be required to register for an account to use certain features of the website, such as reserving or purchasing a ticket. Your account username and password are personal to you. We may refuse registration, cancel an account, or deny access to the website for any reason.
2. Code of Conduct
You agree that you will comply with all applicable laws, rules, and regulations, and will not use the website for any unlawful or harmful purpose.
3. Ownership of Content and Use
This website and everything on it belongs to Story Story Night. We grant you permission to view this website and its contents as permitted by these Terms. If you violate these Terms, or use our website in any unlawful or harmful way, determined at our sole discretion, we reserve the right to deny you access to the website and our services.
4. Purchases
Event tickets, merchandise, and other products and services that we may provide may be purchased from our website. All ticket sales are final. There are no refunds unless an event is cancelled.
5. Pricing and Ordering
Ticket prices and availability are not guaranteed until orders are confirmed. Ticket availability and prices quoted are subject to change without notice. Story Story Night reserves the right to refuse any order at its discretion. Story Story Night will contact you if the tickets you ordered are no longer available or if we are unable to fill the order as you requested.
6. Tickets and Event Attendance
Each purchased ticket is a revocable license to any Story Story Night event and shall remain Story Story Night property. Story Story Night reserves the right to refuse you entry to and/or eject you from the venue in any and all reasonable circumstances at our discretion, including behaving in a manner that negatively affects the enjoyment of other attendees.
7. Limitation of Liability
Except where prohibited by law, in no event will Story Story Night be liable to you for any loss or damage that may occur because of your use of this website, including but not limited to claims relating to injury to person or property; loss of or corruption to data; loss of profit; loss of anticipated revenue; adverse effect on reputation or goodwill; and any direct or indirect or consequential loss or damage. Absent gross negligence or intentional misconduct by Story Story Night, Story Story Night’s total liability to a user for any damage or loss that arises out of or is in any way connected with their use of the website or any services provided through it shall in no event exceed the greater of (1) the total of any subscription or similar fees paid by the user with respect to their access to or use of any service or feature on the website paid in the six months prior to the date of the initial claim made against Story Story Night; or (2) $100.00.
8. Indemnity
You agree to indemnify and hold Story Story Night, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries, and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against Story Story Night by any third party due to or arising out of or in connection with your use of the website.
9. Violation of These Terms
We may investigate any violation of these Terms, including unauthorized use of the website. We may take legal action that we feel is appropriate. You agree that monetary damages may not provide us a sufficient remedy and that we may pursue injunctive or other relief for your violation of these Terms. If we determine that you have violated these Terms or the law, or for any other reason or for no reason, we may cancel your account and prevent you from accessing the Site at any time without notice to you. If that happens, you may no longer use the website or any Story Story Night services. You will still be bound by your obligations under these Terms. You agree that we will not be liable to you or any third party for termination of your access to the website or to your account or any related information, and we will not be required to make the website or your account or any related information available to you. We may also cancel any ticket or merchandise order, and tickets or merchandise acquired through your order. We may refuse to honor pending and future purchases made from all accounts we believe may be associated with you, or cancel a ticket or ticket order associated with any person we believe to be acting with you, or cancel your ticket postings, or exercise any other remedy available to us. You agree that your abusive use of the Site may cause damage and harm to us, including impaired goodwill, lost sales and increased expenses.
10. Governing Law
You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by the laws of the State of Idaho without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by, and venue in, the state and federal courts in the State of Idaho, and waive any objection to such jurisdiction or venue.
